Rules

I. Definitions Used in the Regulations, the following terms mean:

1. Customer – a natural person, legal person, or an organizational unit without legal personality, to whom specific legal provisions grant legal capacity, and who places an order within the Store;

2. Civil Code – the Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended);

3. Regulations – these Regulations governing the provision of electronic services within the internet store available at https://jtwsystem.abstore.pl/;

4. Internet Store (Store) – an internet service available at https://jtwsystem.abstore.pl/, through which the Customer can, in particular, place orders;

5. Product – products presented in the Internet Store;

6. Sales Agreement – a sales agreement for goods within the meaning of the Civil Code, concluded between JTW SYSTEM SP. Z O.O. SPÓŁKA KOMANDYTOWA and the Customer, using the internet store service;

7. Act on Specific Terms and Conditions of Consumer Sales – the Act of July 27, 2002, on specific terms and conditions of consumer sales and amending the Civil Code (Journal of Laws of 2011, No. 432);

8. Act on the Provision of Electronic Services – the Act of July 18, 2002, on the provision of electronic services (Journal of Laws of 2016, item 147);

9. Order – the Customer's declaration of intent aimed directly at the conclusion of the Sales Agreement, specifying in particular the type and quantity of the Product.

10. Business Day – one day from Monday to Friday, excluding public holidays.

11. Order Form – an electronic service, an interactive form available in the internet store that allows placing an order, in particular, by adding products to the electronic shopping cart and specifying the terms of the sales agreement, including the method of delivery and payment.

12. Account – an Electronic Service, marked by an individual name (login) and password provided by the Service Recipient in the Service Provider's ICT system, where data provided by the Service Recipient and information about their Orders placed in the Internet Store are collected.

13. Administrator – a person responsible for the operation and configuration of the internet store.

II. General Provisions

2.1. These Regulations determine the rules for using the internet store available at https://jtwsystem.abstore.pl/

2.2. These Regulations are the regulations referred to in Article 8 of the Act on the provision of electronic services.

2.3. The internet store, operating at https://jtwsystem.abstore.pl/, is run by JTW SYSTEM SP. Z O.O. SPÓŁKA KOMANDYTOWA, ul. BOYA-ŻELEŃSKIEGO 8, 35-105 RZESZÓW, NIP: 8133813189

2.4. These Regulations specify in particular: a) the rules for registration and use of the account in the internet store; b) the conditions and rules for placing orders electronically within the internet store; c) the rules for concluding Sales Agreements using the services provided within the Internet Store.

2.5. In order to use the internet store, the Customer should have access to a computer station or end device with internet access.

2.6. Customers can access these Regulations at any time via a link on the main page of the website and print it out.

2.7. Information about the Products provided on the Internet Store's website, in particular, their descriptions and prices, constitute an invitation to conclude an agreement within the meaning of Article 71 of the Civil Code.

III. Rules of Using the Internet Store

3.1. The Customer is obliged in particular to:

a) not provide or transmit content prohibited by law, e.g., content promoting violence, defamatory or violating personal rights and other third-party rights,

b) use the Internet Store in a way that does not disrupt its functioning, in particular, through the use of specific software or devices,

c) not take any actions such as sending or placing unsolicited commercial information (spam) within the Internet Store,

d) use the Internet Store in a manner that is not burdensome for other customers,

e) use all content posted on the Internet Store only for personal use,

f) use the Internet Store in accordance with the provisions of applicable law in the territory of the Republic of Poland, the provisions of the Regulations, as well as the general principles of using the Internet.

g) The store administrator reserves the right to change or withdraw the offered products due to lack of stock or errors resulting from reasons independent of the administrator.

IV. Procedure for Concluding a Sales Agreement

4.1. In order to conclude a Sales Agreement via the Internet Store, the Customer should go to the website https://jtwsystem.abstore.pl/, choose the Products, and take subsequent technical steps based on the messages and information displayed to the Customer on the website.

4.2. The selection of ordered Products by the Customer is made by adding them to the shopping cart, preceded by the choice of the quantity or type of a specific product.

4.3. During the process of placing an Order - until the moment of pressing the "confirm order" button - the Customer has the option to modify the provided data in the scope of the selected Product. For this purpose, the Customer should follow the messages and information displayed on the website.

4.4. After the Customer provides all the necessary data while using the Internet Store, a summary of the placed Order will be displayed.

4.5. The summary of the Order will contain information on:

a) the subject of the order,

b) the unit and total price of the ordered products,

c) the method of delivery and payment.

4.6. The Buyer purchases the goods and orders the services at prices and costs of delivery individually determined before placing the order or applicable at the time of placing the order.

4.7. The Seller reserves the right to change prices and the costs of delivery, especially in the case of changes in the prices of services provided by the entity performing the deliveries. This provision does not affect orders already placed.

4.8. The current costs of delivery are presented in the "Delivery Costs" tab and are visible at the Cart level. Individual costs are determined in a separate quotation.

4.9. Sending the Order by the Customer constitutes a declaration of will to conclude a Sales Agreement with JTW SYSTEM SP. Z O.O. SPÓŁKA KOMANDYTOWA, in accordance with the Regulations.

4.10. After placing the Order, the Customer will receive an e-mail confirming the details of the Order and its acceptance for processing. The e-mail confirmation of the Order's receipt and acceptance for processing constitutes a statement of acceptance of the Customer's offer referred to in point 4.9 above and leads to the conclusion of the Sales Agreement.

4.11. The Sales Agreement is concluded in the Polish language or English, depending on the Customer's choice, in accordance with these Regulations.

4.12. The content of the Sales Agreement is additionally recorded, secured, and made available to the Customer by sending an appropriate e-mail message to the Customer's e-mail address provided during the Order placement process.

V. Payment and Delivery

5.1. The prices of the Products provided on the Internet Store's website are given in Polish zloty (PLN) or another currency specified on the website.

5.2. The Customer may choose from the following payment methods:

a) Payment by bank transfer to the bank account of JTW SYSTEM SP. Z O.O. SPÓŁKA KOMANDYTOWA;

b) Electronic payments;

c) Other methods available on the website.

5.3. The customer can choose the method of delivery of the ordered Products from the methods available on the website.

5.4. The delivery of the ordered Products is limited to the area specified on the website and is carried out by a courier company, postal operator, or another delivery method specified on the website.

5.5. The delivery time is specified in the description of the Product and may vary depending on the selected method of delivery and the destination.

VI. Complaints and Warranty

6.1. The Seller is obliged to provide the Customer with a product free from defects.

6.2. Complaints related to the provided services or Products may be submitted by the Customer in electronic form to the e-mail address provided on the website or by post to the address of the Seller's registered office.

6.3. The complaint should contain a description of the Customer's claim and the contact details enabling the Seller to respond to the complaint.

6.4. The Seller will consider the complaint within 14 days from the date of its receipt.

6.5. If the Product has a defect, the Customer has the right to submit a complaint based on the statutory warranty provisions of the Civil Code.

6.6. The warranty period for the Products offered in the Store is 12 months, unless otherwise stated in the product description.

VII. Right to Withdraw from the Agreement

7.1. The Customer who is a consumer has the right to withdraw from the Sales Agreement concluded with the Seller through the Internet Store within 14 days without giving any reason. To meet the deadline, it is sufficient to send a statement before its expiry.

7.2. The statement on withdrawal from the Sales Agreement may be submitted by the Customer in electronic form to the e-mail address provided on the website or by post to the address of the Seller's registered office.

7.3. In the event of withdrawal from the Agreement, the Agreement is considered void, and the Customer is released from any obligations. What the parties have rendered shall be returned unchanged, unless a change was necessary in the ordinary course of business.

7.4. The Seller shall immediately, not later than within 14 days from the date of receipt of the Customer's statement on withdrawal from the Agreement, return all payments made by the Customer, including the cost of delivering the Product to the Customer.

7.5. The Seller shall refund the payment using the same method of payment as used by the Customer, unless the Customer expressly agrees to a different method of refund that does not involve any costs.

7.6. The Seller may withhold the refund of the payment received from the Customer until the Product is returned or until the Customer provides proof of its return, depending on which event occurs first.

7.7. The Customer should return the Product to the address of the Seller's registered office immediately, not later than within 14 days from the date on which the Customer withdrew from the Agreement. The deadline is met if the Customer sends the Product back before the expiry of the 14-day period.

7.8. The Customer bears the direct cost of returning the Product, including the cost of returning the Product if, due to its nature, the Product cannot be returned by regular mail.

7.9. The Customer is responsible for reducing the value of the Product resulting from using it in a way that goes beyond what is necessary to establish the nature, characteristics, and functioning of the Product.

VIII. Personal Data

8.1. The administrator of personal data provided by the Customer is JTW SYSTEM SP. Z O.O. SPÓŁKA KOMANDYTOWA.

8.2. The personal data of the Customers is processed in accordance with the applicable law, as detailed in the Privacy Policy available on the website.

IX. Final Provisions

9.1. Agreements concluded through the Internet Store are concluded in accordance with Polish law.

9.2. In matters not covered by these Regulations, the relevant provisions of Polish law shall apply, in particular, the Civil Code, the Act on Specific Terms and Conditions of Consumer Sales, and the Act on the Provision of Electronic Services.

9.3. The Seller reserves the right to amend these Regulations for important reasons, i.e., changes in the law, changes in payment and delivery methods, changes in the Seller's data. Customers who have an Account will be notified of any amendments to the Regulations by e-mail to the address provided. Amendments to the Regulations come into force after 14 days from the date of notification of the Customer. If the Customer does not accept the new content of the Regulations, they should notify the Seller about this fact, which will result in the termination of the contract for the provision of the Account service on the day of the new Regulations coming into force.

9.4. In matters not covered by these Regulations, the relevant provisions of Polish law shall apply, in particular, the Civil Code, the Act on Specific Terms and Conditions of Consumer Sales, and the Act on the Provision of Electronic Services.

9.5. Any disputes arising between the Seller and the Customer who is a consumer shall be subject to the competent courts in accordance with the relevant provisions of the Code of Civil Procedure.

9.6. Any disputes arising between the Seller and the Customer who is not a consumer shall be subject to the court having jurisdiction over the Seller's registered office.

9.7. The Regulations come into force on the date of their publication on the Internet Store's website.
